Terms & Conditions and Instructions for Services to be Provided on the MY PLAN Portal
This instruction defines the terms and conditions of cooperation between the company representatives (My Plan), travelers, and their accompanying persons.
1) Planning a tour
1.1 The traveler plans the travel route/tour;
1.2 The traveler selects the travel destination;
1.3 A travel direction is the route between two points. After choosing the starting location, the search page displays all existing directions from which it is possible to depart from the mentioned location (for example: 21 direction routes are defined from Tbilisi, 20 from Kutaisi, 18 from Batumi, etc.). It is possible to add sub-tours to the selected route, which the traveler also selects and adds;
1.4 The traveler chooses the date and time of the start of the trip, at least 24 hours in advance. The starting time of the trip can be any time between 08:00 am and 11:00 pm;
1.5 The traveler selects the number of travelers. Based on this information, the type and category of the car are determined to comfortably accommodate the passengers, whether it is a sedan, minivan, or jeep;
1.6 During one working day, the duration of the tour should not exceed 10 working hours. This time includes when the driver transports the passenger and waits at the location;
1.7 The tour can be one-day or multi-day, according to the passenger's wish. The tour may include travel from one region to another;
1.8 In the case of a multi-day tour, the driver stays at the mentioned location after the end of working hours and agrees with the traveler on the details for the next day's tour. During a tour of two or more days, the cost of the driver's stay at the location is added to the basic travel cost - 80 GEL. In the case of a desire to travel for two or more days, to reserve/book a hotel room or flat at the desired locations, a BOOKING.COM reservation button designed for the said location is added to the My Plan constructor, from which the passenger can book the apartment or hotel of their choice. Of course, the passenger pays according to the BOOKING.COM payment rules.
2) How the Tour Constructor Works, Principle, and Price Determination
1) The traveler selects a tour from point A to point B. Marking points automatically determines the distance between locations in the system. The trajectory from one location to another in the constructor is arranged sequentially, from the starting location to the next closest location;
2) Between the mentioned points A and B, it is possible to add various locations along this route, which may require deviating from the main route and waiting after reaching the location. The arrival time, waiting time, and cost at the mentioned locations are specified when choosing the location. Prices are fixed for all locations, depending on the time spent on the spot. The amount fixed by the traveler when purchasing a tour does not change and corresponds to the period of arrival and waiting of the passenger at a specific location;
3) The types of locations include historical heritage (chapels, temples, monasteries, churches, walls, castle towers, etc.), museums, cafes, restaurants, wineries, and small enterprises. Additionally, at certain locations, the traveler can learn about the activities of local entrepreneurs who produce different types of traditional Georgian products. The list of locations also includes caves, natural landscapes, canyons, protected areas, etc;
4) At facilities where entry is paid, the traveler pays the entry fee upon arrival. The cost of transportation to the location does not include the ticket fee. Also, the cost of cafe and restaurant services is not included in the entrance fee to the location. The cost of catering depends on the traveler's order;
5) The driver has the opportunity to choose the optimal route after consultation with the passenger if it serves to create more comfort for the passenger. The driver does not have the right to cancel the tour if there is no problem to continue the journey in terms of time;
6) Changing the tour is allowed by agreement with the traveler if it is impossible to get to a specific location or the working hours of entering the said object have ended. Also, if there are difficult meteorological conditions or it is not possible to move safely to the location due to nightfall;
7) If during the purchased tour, it is not possible to bring the traveler to the destination, which is caused by the traveler's elective use of time, the said action will not result in a change of the amount. If the traveler uses the duration of the purchased tour according to their wishes, such action is allowed if they continue to stay in the desired location in exchange for moving to another location;
8) As soon as the tour is booked, the driver is sent detailed information about the tour details: the location of the traveler, the contact information of the traveler, and the contact person (if there is any). Before starting the trip, to use the time effectively, it is recommended that the passenger contacts the driver;
9) If during the tour, due to the driver's fault or car malfunction/failure, it's impossible to finish the mentioned tour and transfer the traveler to the current locations, the MY PLAN office should be informed about this, to replace the vehicle, continue the tour, or make other arrangements. If the mentioned situation results in a financial change, the decision will be made in favor of the traveler based on mutual agreement;
10)In case of conflict with the driver, it is necessary to contact the MY PLAN office. However, if the cause of the conflict goes far beyond professional communication and it has an illegal nature, it is mandatory to call the police.
3) Tour Cancellation and Refund Policy
1) Tours are planned at least 24 hours before their start time. A tour is considered confirmed once the traveler receives the message "confirmed by the driver" in their traveler's cabin;
2) Travelers may cancel a tour and receive a full refund of the paid amount if they do so at least 24 hours before the tour's start time. If the cancellation occurs within 24 hours of the tour start time, a 50% refund of the paid amount will be issued;
3) For tours paid for by bank card, when a passenger requests a refund, the process will include the procedures specified by the bank, including any applicable transfer periods.
4) Traveler's Rights and Obligations.
1)The traveler pays the tour fee in advance;
2) When using bank cards, the company does not save the data of this bank card. Payment is made through a banking institution recognized by Georgian and international banking systems;
3) The traveler receives the tour plan, including the list of locations, their directions, the estimated time of arrival at the locations, and the duration of the delay at each location. The traveler then confirms this information;
4) The traveler can stop the tour before the scheduled time, according to their wish. In this case, the tour is not compensated if it’s for only one day;
5) If the tour is multi-day and the next day's program is canceled, only the next day and its following days will be canceled. The cost of transportation to the locations will be deducted from the refundable amount;
6) The traveler does not have the right to request a full refund due to the termination of the tour at their will;
7)The traveler has the right to replace or change the time of delay or waiting at the locations within the purchased tour, but only within the time specified by the tour;
8) The traveler has the right to continue staying at a location if they pay for additional time. For example, if the stay time at a location is 1 hour, the passenger can use the time to arrive at the next location to stay at the current location. As a result, travel distance will be reduced, and additional time will be purchased. If the traveler requests to add additional time and location simultaneously, the cost will be calculated as follows: 1 hour is 20 GEL, plus the product of the added distance at 0.9 GEL for jeeps and 1.4 GEL for minivans.
5) General Provisions
1) These instructions and rules are mandatory for all parties involved, including company employees, drivers, and travelers, to ensure that no party suffers material damage;
2) All parties should familiarize themselves with these written instructions;
3) For practical and effective communication, a customer support chat (SUPPORT CHAT) is available on the portal. This chat is used for operational communication with colleagues and the MY PLAN office when necessary. Additional inquiries for improving the trip are also received here;
4) Travelers are notified of possible changes in the travel schedule through SMS and email messages. In the event of changes in prices and types of locations entered in the tour constructor, additional notifications will be provided.
6) Price Calculation Mechanism
1) When calculating the price, it is taken into account to maintain competitiveness with the current prices in the market;
2) The trajectories of the routes are based on the data available in Google Maps and other navigation systems. The time taken to cover the distance corresponds to the transportation norms within the territory of Georgia;
3) The prices in the tour constructor are fixed and determined for each tourist location based on practical experience and the individual characteristics of the location;
4) The mentioned "Terms & Conditions and Instructions for Services" have been uploaded on MY PLAN's official website and are used exclusively for MY PLAN activities. The service recipients and providers jointly agree to use the mentioned instructions and act according to the established rules, considering the interests of third parties.
